Allen, Alicia Giordano, Laurie Rodriguez, Jen Stratton, JoAnn Wofford, Amy Litzinger, Laura Villareal, Ray Tijerina, Susan Nichols, Teresa Bronsky, Elizabeth Donaldson, Rachel Dreiling CAC Absentees: Jana McKelvey, Jana Burns, Stephanie Martinez Texas Education Agency: Keith Swink, Justin Porter 9:00 Welcome and Opening-Agatha Thibodeaux, CAC Chair Agatha Thibodeaux opened the meeting, reviewed meeting guidelines, and agenda for the day. Quorum was present. 9:10 Justin Porter updated the committee on resources the Texas Education Agency has supplied to local education agencies including the ϲʿ2023 COVID-19 website & Texas Statewide Leadership for Autism Training (TSLAT), Tiered Interventions Using Evidence-Based Research, (TIER), and Texas Complex Access Network (TX CAN) information. Justin also updated the committee on the recent letter received from theOffice of Special Education Programs (OSEP) concerning the corrective action response. The committee then asked questions about presented information and other special education topics. Laurie Rodriquez asked questions about the new Supplementary Special Education Services (SSES) program including what was the thought process for SSES, whose idea was it, who were the stakeholders who made this multi-million-dollar decision, what's the projected price tag, and what is the process for collaboration with the SSES process. 9:50 Break 10:00 Discussion, recommendations, and possible action on CAC 2021 Legislative Report- Agatha Thibodeaux Full and Individual Evaluation-The committee agreed to add the administrative perspective to this recommendation. Mental Health-Laurie Rodriguez shared all of the mental health trainings required by educators now under current state statues. There was discussion on whether the recommendation was a repetition of training requirements already mandated by legislation passed in previous legislative sessions. The committee agreed to not make this a formal recommendation but to add it to the committees vision and values statement. Data Privacy-The Data Privacy recommendation was presented to the committee. Rachel Dreiling explained the sub-committees rationale and reasons behind the recommendation. The language of special education disability eligibility status and Section 504 disability status was added to the recommendation. The committee agreed to add the recommendation to the legislative report. Staff Qualifications-The committee agreed to add the administrative perspective to this recommendation. 11:00 Public Comments-Agatha Thibodeaux Steven Aleman, Disability Rights Texas-Disability Rights has many questions about SSES program. The program will be funded using federal COVID funds with an outside contractor managing the program. Disability Rights also has concerns about data privacy as well. In regards to federal oversight and the recent letter received from OSEP; Steven discussed that there are still systemic practices happening in the state when it comes to denying special education services that need to be addressed. Steven also informed the committee that yesterday was first day to file bills for the upcoming legislative session and there have been a few special education bills filed. 11:04 Reconvene discussion, recommendations, and possible action on current minutes and future meeting topics-Agatha Thibodeaux Person-Centered Planning-Amy Litzinger discussed specifics on the recommendation. The committee agreed to add the recommendation to the legislative report. Discussion was held on next steps on the report in regards to editing and formatting of the final copy of the report. Editing and formatting changes will take place via Google docs. Any additional content added to the report would require another scheduled meeting. The executive summary was also reviewed and language about trauma-informed care and mental health was added to the teacher certification section. JoAnn Wofford asked about training for substitute teachers as a result of teachers not returning to the classroom due to COVID-19. The committee agreed to add a summary statement regarding COVID-19 and COVID-19 response in regards to the recommendations in the report to the executive summary. The next meeting is scheduled for February 18, 2021. Justin Porter will update the committee on special education topics at the February meeting including SESS and remote learning. Laurie Rodriquez also suggested getting an update on the progress special education bills in the current legislative session. A sub-committee was formed to look at the progress of special education bills in the legislative session and report back to the committee at the February 2021 meeting.
